Trina withdraws Sec. 337 investigation complaint against Canadian Solar

Trina Solar has requested updates to its Sec. 337 of the Tariff Act investigation against various competitors producing TOPCon solar panel products. Trina in October 2024 requested the U.S. International Trade Commission (ITC) complete the investigation, which would direct U.S. Customs to stop infringing imports from entering the United States, against TOPCon solar imports from Runergy, Adani Green Energy and Canadian Solar.

Before the end of last year, Trina said in documents filed with the ITC that it had reached an agreement with Canadian Solar and its affiliates and wished to withdraw the complaint and terminate the investigation. Separately, Trina said it met with Adani and wishes to withdraw its complaint against the Indian company, instead adding Mundra Solar PV (an Adani subsidiary) as the company under investigation. Trina intends to continue the complaint against Runergy and now Mundra.

This Sec. 337 investigation request originates with TOPCon patent infringement claims filed by Trina against the companies. Trina claims that Runergy and Canadian Solar are infringing on two of Trina’s patents (Nos. 9,722,104 and 10,230,009). While a Sec. 337 investigation is ongoing, the patent infringement cases are stayed.
